The COMPLIANCE MANAGEMENT MODULE allows companies to register and monitor their social and environmental performance to help them manage their public commitments. Key performance indicators can be defined to provide an overview of these commitments, provide a mechanism to summarize performance, and produce outputs or reports to external stakeholders. High-level reporting can be used to produce corporate sustainability reports that reflect community, lenders, voluntary, and government standards.

This module also provides a formal process to manage and monitor the contractors' performance and compliance as well as activities relating to specific commitments.

Another component of the module is the tracking and management of monitoring activities and reviews that are conducted in order to verify compliance with project requirements and conditions and to launch appropriate corrective actions when necessary.

Commitments

Each commitment made by the company is registered and categorized according to intensity, validity period, and the type of issue it represents. These commitments involve social or environmental issues and are established on both a regulatory and voluntary basis. Commitments can be grouped into management plans to help ensure the requirements are acted upon and tracked.

Monitoring

  • Verification Actions
    The commitments to be fulfilled are then translated into measurable and verifiable actions. Each commitment can be translated into several actions, or one action can represent several commitments.
  • Verification checklists
    Given the scale of many projects in the mining and oil and gas industries, it is necessary to prepare for internal and external inspections in a strategic manner. This part of the compliance management module groups verification actions into several types of templates that facilitate the verification process. The templates are created and managed according to geographic area, social and environmental themes, or other company selected criteria.
  • Verification and reviews
    Verifications are performed in order to verify cases of compliance or non-compliance either for social or environmental parameters. This part of the module can also be used to assess contractors' performance and their compliance to contract terms and conditions.
  • Non-Compliance Registry and observations
    Observations made during the verification phase can potentially evolve into cases of non-compliance. The non-compliance registry contains each non-compliance case categorized according to the severity of the situation.
Observations can also relate to positive actions and can be used to communicate best practices.

Audit & Assessment

Audits in particular are utilized to identify the company’s level of conformance with defined standards and procedures through the sampling of evidence. This can include documentation, records, interviews and field checks. Assessments are generally not as detailed as audits and are a method of evaluating performance and achievement. Both activities can be conducted either internally or externally on a punctual basis. The process allows the identification of non-conformities and areas for improvement. The registration of results within the system acts as a basis for further implementation of a corrective actions plan. Tracking of all audit activities (e.g. meetings) as well as audit reports is also possible.

Incident Management

Incidents relating to the social and environmental aspects of a company's operations are common in the mining and oil & gas industries. These can be minor or major incidents such as work stoppages related to labor unrest or small wastewater spills that nonetheless have to be recorded for compliance reasons and reported to government regulatory agencies. Incident management is the process by which these incidents are formally identified, dealt with, followed up upon, and monitored in order to ensure continuous improvement and operational continuity. Each incident that has occurred is registered and classified according to type and severity, and a full summary and description of the incident is recorded along with any immediate corrective actions that have been taken to address the situation as explained in the next section.

Corrective Actions/Recommended actions

For each non-compliance revealed in the verification or audit & assessment process, corrective actions are created and a tracking mechanism is put in place until resolution.

Corrective actions can translate into one or several practical tasks, which can be assigned to the appropriate person through the task management module. A follow-up process can be implemented through alerts and reminders sent by emails.
